Since June 1980 Ross has practised as a barrister, initially for more than ten years in criminal trial work and family law and then latter in the nineties and currently in general civil law.
His initial work also entailed some prosecution of company directors for the Victorian Corporate Affairs Commission for offences of non compliance with the statutory requirements and also some general criminal law offences in the County Court.
However over the last ten years he has tended to concentrate on commercial litigation, administrative law, small business disputes, and employment matters including unfair dismissal / discrimination equal opportunity law and most recently native title. He has also in 1999 to 2000 practised full time in the Northern Territory and later as visiting Counsel since then, where he was involved in advice to the Territory government relating to various land disputes including some limited indigenous land compensation issues involving the new rail link. In 2003 he completed a post graduate course in Native Title Law and Practice at University of Melbourne and in late 2004 early 2005 was an advisor to Victorian indigenous claimants for future act and general native title claim work. His general civil law practice includes disputed insurance claims, claims on the basis of director's guarantees, partnership disputes, actions between banker and customer, disputes concerning sales of businesses, actions for the recovery of land, disputes between mortgagee and mortgagor, proceedings to enforce securities and the ordinary debt matters. He has also substantial experience in domestic building disputes as a result of his period as a mediator in the Domestic Building List. He has also had experience in banking practice which involves advice as to the binding effect of contracts and the enforceability of guarantees (both personal and director's), and mortgages.
He appears in all State courts and VCAT, including the now recently increased Magistrates Court civil jurisdiction. In addition to trials, he also appears in the hearing of originating motions, injunctions, and orders to review decisions of the Magistrates' Court and numerous applications and ancillary matters in the Masters or Directions Court.
Ross has a very substantial mediation/ADR practice involving most commercial / mercantile business issues; this is demonstrated by his appointment to the following positions:
- Domestic Building Tribunal mediator from 1996 to 1997
- Victorian Small Business Commissioner’s Panel of accredited mediators relating to unconscionable business conduct and retail tenancy disputes in 2003 and continuing.
- Australian Industrial Relations Commissions Panel of Mediators (Vic) June 2005
- Office of Mediation Adviser’s (Franchising Code of Conduct) Panel of accredited mediators for the Northern Territory and Victoria, in1999 and continuing pertaining to franchise disputes;
And is also;
- A member of the Victorian Bar Equality before the Law Committee 2003, and continuing
- Appointed 2005 to the Victorian Bar Indigenous Lawyers Committee.
- Appointed in 2006 as The Chairman of The Victorian Bar Dispute Resolution Committee
